Service Availability & Performance – Gearheart Broadband services are subject to availability and may not be offered in all areas. Actual internet speeds, performance, and latency may vary based on network conditions, service location, customer equipment, in-home wiring, Wi-Fi configuration, number of connected devices, and internet traffic. Advertised speeds represent maximum wired speeds under ideal conditions and are not guaranteed.

Equipment & Installation – Gearheart-provided equipment (including modems, gateways, routers, and managed Wi-Fi devices) remains the property of Gearheart Communications unless otherwise stated.

• Installation fees, equipment fees, and service activation charges may apply.
• Customers are responsible for maintaining safe and secure access to equipment and premises.
• Damage, loss, misuse, or failure to return Gearheart-owned equipment may result in replacement or non-return fees.
• Customer-owned equipment must be compatible with Gearheart Broadband service and meet network requirements. Gearheart is not responsible for service issues caused by unsupported or improperly configured customer equipment.

Customers are responsible for:

• Proper use of the broadband service in compliance with all applicable laws, regulations, and Gearheart Acceptable Use Policies.
• Securing personal networks, devices, passwords, and Wi-Fi access.
• All activity conducted through their broadband connection, including activity by household members, guests, or connected devices.
• Maintaining adequate electrical power and surge protection for connected equipment.

Gearheart is not responsible for data loss, security breaches, or service interruptions caused by customer-owned devices, third-party software, malware, viruses, or unauthorized access.

Data Usage & Network Management – Most Gearheart Broadband plans include a monthly data allowance unless otherwise stated. Data usage includes all inbound and outbound traffic, including streaming, gaming, downloads, uploads, software updates, cloud services, and connected smart devices.

• Customers who exceed their monthly data allowance may experience reduced speeds, additional charges, or be required to upgrade to a higher data tier.
• Data usage resets monthly. Unused data does not roll over.
• “Unlimited” data plans are subject to reasonable network management practices and may be restricted to a maximum usage threshold per billing cycle to ensure fair access for all customers.

Gearheart reserves the right to manage network traffic to maintain service quality and reliability for all subscribers.

Service Agreement & Billing – By subscribing to Gearheart Broadband, customers agree to all applicable service terms, policies, and pricing in effect at the time of service.

• Monthly service fees, taxes, surcharges, and regulatory fees may apply.
• Prices, packages, and features are subject to change with notice as required by law.
• Promotional pricing, discounts, or bundled offers may be limited-time and revert to standard rates after the promotional period.

Early termination fees or equipment return requirements may apply if service is disconnected prior to the end of an agreed service term.

Service Interruptions & Maintenance – Gearheart may occasionally perform maintenance, upgrades, or repairs that result in temporary service interruptions. While every effort is made to minimize disruptions, Gearheart is not liable for outages caused by weather, power failures, acts of God, third-party providers, or circumstances beyond its control.

Limitation of Liability – Gearheart Broadband is provided “as is” and “as available.” Gearheart shall not be liable for indirect, incidental, or consequential damages, including loss of data, revenue, or business, arising from the use or inability to use the service.

Changes to Terms – Gearheart reserves the right to modify service offerings, equipment requirements, data policies, and terms at any time. Continued use of the service constitutes acceptance of any updated terms and conditions.
